Richard Keith Smith came to the attention of law enforcement from a tip by Operation Blue Ridge Thunder, a law enforcement entity that monitors individuals that visit sites that contain child pornography. Based on evidence that Smith was visiting those sites, a search warrant was obtained for Smith’s residence and computer. His computer was sent off to the forensic lab for analysis and digital images of child pornography were found. However more disturbing were still Polaroid photographs found in his home that depicted sex acts with children. One particular photograph showed Smith, himself, engaging in those acts.
Commonwealth’s Attorney Mike Fleenor presented 13 indictments to the Grand Jury including 7 for forcible sodomy, 1 for aggravated sexual battery and 5 for possession of child pornography. Shortly before the scheduled jury trial, Smith pled guilty to all 13 counts. He was sentenced to serve 44 years in the state penitentiary. He is currently at Pocahontas State Correctional Center in Tazwell County, Virginia.
